Please check your citation to make sure it was issued in Emanuel County.  This can be checked by looking at Section III Location.      

Next verify that the citation was issued by the Georgia State Patrol, Department of Transportation, or Emanuel County Sheriff's Office.  This can be checked by  looking at the top of the citation      

Once you have verified that the citation was issued  in Emanuel County  by either the Georgia State Patrol,  Department of Transportation, or the Emanuel County Sheriff's Office you may dispose of the citation in the following manner:      

You will receive a Court Notice from the State Court of Emanuel County regarding the citation that you have been issued.  This Notice will be mailed to you at the address on your license.  If the address on your license is not correct, you must call the Clerk of Court at (478) 237-8911.      

The Court Notice will inform you of your fine and court date.  Court is held on the second Monday of each month at 4:30 p.m. in the Emanuel County Courthouse.  The Courthouse is located on the corner of South Main & East Moring Streets in Swainsboro, Georgia.      

If your Court Notice does not list a specified a fine amount, then you must appear in Court.  The following charges always require an appearance:      

DUI     DRINKING/POSSESSION ALCOHOL UNDERAGE
LAYING DRAG  PERMITTING UNLICENSED PERSON TO DRIVE
FLEEING/ELUDING  ALL DRUG/ALCOHOL OFFENSES

If you received a notice with a specified fine amount and wish to settle the matter without appearing in court you may do so by mailing a Cashier's Check or Money Order, DO NOT SEND CASH 

made payable to: Emanuel County Sheriff Office      

mail to:  Post Office Box 703      

Swainsboro, Georgia 30401      

Payment must be received by the Friday prior to the Court date.  Please include a copy of the citation(s) and make sure that both your name and the citation number are on the Cashier's Check or Money Order.  Failure to do so will result in your payment not being posted and your license being suspended!

If you wish a receipt, please enclose a self-addressed, stamped envelope with your  payment.      

You cannot enter a Not Guilty Plea by mail.  You must appear in Court to enter a plea or explanation.  As with any court case, you have the right to obtain an attorney and have him/her present for court.  If you have witnesses, it is your responsibility to produce them for Court.      

Failure to Appear in Court at the notified date and time to dispose of the citation issued against you shall cause the designated Court to forward your driver's license to the Department of Public Safety, and your driver's license shall be suspended. (Georgia Code 17-6-11 and 40-5-56)  The suspension shall remain in effect until such time as there is a satisfactory disposition in this manner or the Court notifies the Department of Public Safety.
